Divorce or Separation and Retirement
The problems divorce or separation can create for both parties in retirement and how to manage those risks.
Key Takeaways
- If divorcing after retirement, use a Qualified Domestic Relations Order (QDRO) to properly split ERISA-covered private pension benefits—improper drafting can invalidate the entire split
- Divorced individuals can claim Social Security spousal benefits on an ex-spouse's record if married 10+ years, but this benefit ends immediately upon remarriage
- Maintain two separate households after divorce costs significantly more than one joint household—factor this into your retirement budget projections and asset division negotiations
- Before remarrying in retirement, especially with children involved, establish a prenuptial agreement to define property rights and prevent courts from deciding asset distribution in a future divorce
- Hire professionals specializing in retirement divorce (not just general divorce lawyers) to understand how pension plans, Social Security, and other retirement income streams are affected by marital status changes
